Terms of Service

ZecMarket is a peer-to-peer marketplace for physical goods. Payments are private Zcash shielded transactions. Privacy is not a licence to break the law. These terms explain the rules, what we do when they are broken, and what data we do and don't hold.

1. Who can use ZecMarket

  • You must be at least 18 years old and legally able to enter into a contract where you live.
  • You may not use ZecMarket if we have banned you before, or if you are barred from receiving these services under the laws that apply to you, including sanctions laws.
  • You are responsible for everything done through your account and for keeping your account number, passkeys and wallet secure. We do not collect an email address, so we cannot reset your login: if you lose your account number and all of your passkeys, the account cannot be recovered.
  • You must accept the current version of these terms before you list, buy, make or accept offers, or send messages. When we change the terms materially, we will ask you to accept them again.

2. What ZecMarket is (and isn't)

  • ZecMarket is a venue that connects buyers and sellers. We are not the buyer or the seller of any item and we do not take ownership of goods.
  • Payments are Zcash shielded transactions. During this early (beta) period, ZecMarket receives the buyer's payment and holds it until the order is completed, then pays the seller. Our website server only holds a view-only key and never your spending keys, but the operator of ZecMarket controls the funds in the meantime. Do not use ZecMarket for amounts you cannot afford to lose while it is in beta.
  • During beta, payouts and refunds are sent manually by an administrator after the rules below create a payout request, so they are not instant. The network fee for sending a payout or refund is paid by ZecMarket, not deducted from your amount.
  • During the current MVP, only physical goods may be listed. Services, digital goods, accounts and subscriptions are not allowed.

3. Prohibited items and conduct

You may only list, buy, sell or discuss items that are legal for both the buyer and the seller where each of them lives, and that are not on our Prohibited Items policy. That policy is part of these terms.

You also agree not to:

  • post false, misleading or deceptive listings, or misrepresent an item's condition, origin or authenticity;
  • defraud, scam, threaten, harass, or abuse other users, or send spam;
  • use code words, misspellings, images or other tricks to get around our screening;
  • launder money, evade sanctions, or use the platform to move value for anything other than a genuine sale of a lawful item;
  • create multiple accounts to evade a ban, limits or reviews, or manipulate reviews and ratings;
  • try to take a transaction off-platform to avoid these rules;
  • attack, scrape, overload, reverse-engineer or interfere with the service.

4. Zero tolerance, moderation and enforcement

  • We apply a zero-tolerance policy to the items and conduct in the Prohibited Items policy.
  • Listings are automatically screened when you create or edit them. Listings that clearly break the rules are rejected. Listings that might break them are held as "pending review" and stay hidden until a moderator approves them.
  • Users can report listings, users and individual messages. Moderators review reports and may remove content, cancel listings, and suspend or permanently ban accounts, with or without warning.
  • Moderator actions are recorded in an internal audit log.
  • Banned users may not create new accounts. We may ban related accounts we reasonably believe are operated by the same person.

5. Cooperation with law enforcement

We respond to valid legal process (such as subpoenas, court orders and search warrants) from competent authorities. We may also report apparent child sexual abuse material, credible threats to life, and similar emergencies to the relevant authorities without waiting for a request. We will only ever hand over the limited data we actually hold (see section 6). We cannot hand over what we don't have.

6. What data we hold, and what we don't

We are designed to collect as little as possible. In plain terms:

  • Account data we hold: your account ID, pseudonymous handle, a one-way keyed hash of your account number (not the number itself), the public keys of any passkeys you add, profile details you choose to add, your listings, offers, reviews, reports, and order records (item, price, order status and timestamps). We do not ask for your email address, name or phone number to create an account.
  • Payout and refund addresses: sellers give a Zcash payout address and buyers give a refund address. We store them only to send you your money, show them only to you and the administrators who send it, and never show them to other users.
  • Payments: payments are Zcash shielded transactions. In beta we hold the funds for an order until it completes (see section on payments above); we never hold or ask for your own spending keys. To confirm that an order has been paid, our server uses a view-only key that can see incoming payments to order addresses. We do not publish payment details, and the public blockchain does not link buyer, seller and amount.
  • Shipping: when you use a carrier pickup point (for example a parcel locker or carrier access point), we store the pickup point, not your home address, and the seller never sees your home address. If you choose home delivery instead, the address you give is shared with the seller and the carrier to deliver your item.
  • Messages: messages between buyers and sellers are stored encrypted at rest and are automatically deleted 30 days after the related order closes.
  • Reports: when a message is reported, a copy of it is attached to the report and kept, together with the report, for as long as needed to review the report and keep records of enforcement decisions. This holds even after the original conversation is deleted.
  • Technical data: like any website, our servers and service providers may process IP addresses and basic logs for security and abuse prevention. We keep these only for a limited time.

7. Buying and selling

  • Sellers must describe items accurately, own them or have the right to sell them, and ship them promptly to the chosen carrier pickup point or address. Sellers must set a payout address before listing an item or marking an order shipped.
  • Ship deadline and tracking: after the buyer's payment is confirmed, the seller has 5 days to mark the order shipped with the carrier and a valid tracking number. We remind the seller halfway and at 90% of the deadline. If the seller does not ship in time, the order is cancelled automatically and the buyer is refunded in full to their refund address.
  • Buyers must give a refund address before buying or making an offer, pay the agreed amount to the order's payment address and collect items promptly.
  • Releasing payment: payment is released to the seller when the buyer confirms delivery. If the carrier reports the item delivered, the buyer has 3 days to confirm or open a dispute, after which the order completes and the payment is released. If there is no delivery information, the order completes automatically 14 days after shipping. Opening a dispute stops any automatic release.
  • Disputes: either party can open a dispute while the order is paid or shipped, and the buyer can do so during the 3-day window after delivery. An administrator decides whether the full amount is released to the seller or refunded to the buyer. Release and refund requests are executed manually by an administrator during beta.
  • The contract for a sale is between the buyer and the seller. Taxes, customs duties and import rules are their responsibility.
  • If something goes wrong, you can open a dispute. We review disputes and may release the funds to the seller or refund the buyer. Payments that were already sent to the wrong address, or after an order expired, may not be recoverable automatically and are handled case by case.

8. Your content

You keep ownership of what you post. You give ZecMarket a licence to host, display and process it to run the marketplace. You confirm that you have the right to post it and that it does not infringe anyone else's rights.

9. Disclaimers and limitation of liability

The service is provided "as is". To the extent the law allows, ZecMarket is not liable for items bought or sold, for the conduct of users, for losses caused by blockchain networks, wallets or carriers, or for indirect or consequential losses. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Changes and termination

  • We may update these terms. When we make a material change, we will ask you to accept the new version before you continue trading.
  • You may stop using ZecMarket at any time. We may suspend or end your access if you break these terms or if we have to by law.
